THE WILL OF DÕNA MARIA IGNACIA URRUTIA

February 7, 1812

In the name of God and His Most Holy Mother, Our Lady, who conceived by grace without original sin.

Be it well known by this my last will and written testament, that I, Maria Ignacia, a widow, am a resident of the City of San Fernando de Bexar.

Though I am seriously ill, I am in possession of sound mind, memory, and understanding. Being so endowed with reason, I realize, especially since I am thus confined to my bed, that death is the natural debt of all creatures, and that it will claim us without our knowing the hour of it's coming.

I firmly believe in the Most Holy Trinity, Father, Son, and Holy Ghost, three separate persons but only one true God, and I believe all the others creeds in which Our Holy Mother Apostolic Roman Catholic Church believes and confesses.

With our Most Holy Mother of Guadalupe as my advocate and guide as she has been all my life and I pray her to continue to be, to strengthen my faith, I make, publish and declare this my last will in the following manner.

FIRST: I commend my soul to God who created it and redeemed it with His most precious blood. It is my wish that my body be shrouded in the robe of the religious order of our Patron Saint Francis, and buried in the Campo Santo of this city. If it is God's will, I desire to be buried in the morning, and to have nine low masses celebrated in the Parochial Church, beginning on the day of my funeral. The other burial arrangements I leave to the good judgment of my executors and I order my wishes to be respected in these matters.

SECOND: It is my will that 100 pesos be dedicted from my estate to pay for 100 masses to be celebrated in the following manner for the repose of my soul: 25 in the Mission of Espiritu Santos in the Presidio of La Bahia, 25 in the Mission known as Nuestra Senora del Refugio, 25 in San Francisco de la Espada, and 25 in the Mission San Jose. I command this to be done.

THIRD: Although I do not recall that I owe any debts, if any persons should present claims against my estate and fully prove my indebtedness to them. I desire my executors to pay these debts from the corpus of my estate. I order this to be done.

FOURTH: I declare that I was married in the first nuptials to Don Simon de Arocha, Commander of the Corps of Militia of Texas. During our marriage I bore my husband six children:

Miguel

Ignacio

I brought no dowry whatever to my said husband. This is the Truth.

FIFTH: I declare as my property the following real estate: a stone house, situated in the Plaza of this city; it is bounded on the West by the Acequia, on the North by a lot which is the property of Don Vicente Travieso, and on the South by the said Plaza. The lot consists of 40 varas frontage and 60 varas depth and the house consists of a hallway, a living room, and two bedrooms; the remainder of the 40 varas is enclosed by one solid wall. This I state to be true.

SIXTH: I declare that I possess and claim as mine the following: two iron pots, two metates, one trunk, four flannel nightgowns, two underskirts, two pairs of top skirts without padding, one cot covered with hide, two sheets, one pair of pillows, one picture of Nuestra Senora de Guadalupe, one bench, one table, and one blue muffler. This is the truth.

Seventh: I declare that I have brought action against Alferez Juan Antonio Urrutia concerning a lot for which he has not yet paid me in full but which is reputed to belong to him, I order my executors to collect from the said Urrutia what he lawfully owes and to carry out my orders in this particular.

EIGHTH: I declare that it is my last wish that the property known to be mine, listed in the above clauses, be distributed equally among in the above children, whom I charge to conduct themselves with complete harmony and brotherly affection. I order this to be done.

NINTH: I name and appoint as my executors, first, my son the priest, Clemente Arocha, and second, my son Francisco, and it is my desire that they as my executors carry out the provisions of this my will. I give them jointly and severally all power and authority necessary to dispose of or sell what they consider the most liquid of my assets if necessary to pay the bequests, legacies, church fees, ceremonies, and funeral and burial expenses mentioned in this will , carrying out my wishes in every detail. I pray them to acquit my conscience as I lay that burden on theirs, and whatever they may do thus, shall be as valid, binding and legal as if I myself had acted. I direct this to be done.

TENTH: I order my executors to pay the fees known as the compulsory church bequests, whatever is customary in this (city).

It is my desire that this be recognized as my last will and testament and that it be qiven the full faith and credit which it merits under the law. Because some certain clause has been omitted, it should not have less validity and force that it would have if such a clause had been incorporated in it.

In this faith and belief thus expressing my intention, I executed this instrument as shown herein, but did not sign it because I did not know how to write. At my request Vicente Gortari, a resident of this city of San Fernando de Béxar, signed for me, January 7, 1812, in the presence of the Commissioner, Captain Luis Galan, and the witnesses to his proceedings, in the form and manner in which they will sign below

Native of San Antonio, he was a Roman Catholic Priest who studied in Mexico City for the priesthood.

After his studies, he served as local pastor at the San Fernando Cathedral, San Antonio, Texas.

He is listed as 27 year of age on the 1790 census of San Antonio. He was quite active in the revolutionary movement of 1811-1814, and subsequently he was transferred to Laredo in 1811.

Joaquin Leal, born 1745, was the son of Bernardo Leal and Leonor Delgado, who came from the Canary Islands and founded this city of San Antonio, which they originally named Villa of San Fernando in March 9, 1731. His grandfather, Juan Leal, was 56 years old a widower when he arrived here in 1731, and married the widow Delgado. Juan Leal was the first Mayor of this city and the first Judge. He came from the Island of Lancerote, Canary Islands. They had been in that island since 1460 where they came from the mainland of the Southern Part of Spain. All the men were given the title of "Hidalgo" which title still carries to all their male descendants and are considered "Knights of the Frontier". Joaquin married Ana Maria Arocha, granddaughter of Francisco Arocha, the first secretary and notary public of the villa of San Fernando. Her mother was from the old Urrutia Spanish military family. Joaquin and Ana Maria donated the land for what is now St. Joseph Catholic Church, as family tradition states. Joaquin also owned five ranches in what is now the city of Elmendorf, Texas and is an ancestor of this author, John O. Leal.

Notes for FATHER JOSE DARIO ZAMBRANO:

Father José Darío Zambrano (Sambrano), a Catholic priest, was born in San Antonio on December 17, 1768, the son of Don Joseph Macario Zambrano and Dona Juana de Ocon y Trillo. His father was a recent immigrant from Saltillo, Coahuila, Mexico, who soon became a prominent rancher. Among Darío's numerous brothers and sisters was his younger brother Juan Manuel Zambrano, with whom Darío has often been confused. As a young man Darío was sent to the interior of New Spain to study for the priesthood and was ordained in Monterrey in May 1793. Little is known about where he ministered between then and 1811, except for a few months service as substitute pastor of Matamoros in 1800 and his time as pastor of Santa Rosa, Coahuila, in 1807-08. Zambrano was in San Antonio when the Casas Revolt broke out in early 1811, and he joined in the Royalist counterrevolution led by his brother Juan Manuel Zambrano. When the pastor of the local San Fernando Church was implicated in a revolutionary plot a few weeks later, Zambrano was appointed to replace him. He served as pastor of this San Antonio parish from late March 1811 until his retirement in late 1816. For a while in 1811 he also became temporary chaplain of the Presidial Company of Béxar. When the revolutionary forces of the Gutiérrez-Magee expedition occupied San Antonio in 1813, Zambrano joined the loyalist troops who were forced to withdraw from Texas. He was one of the chaplains with those troops when they returned in August and routed the insurgents at the battle of Medina. One of those who fled to safety in Louisiana after this defeat was Don Vizente Tarín, for whose child Zambrano had stood as godfather. Tarín remained along the Louisiana border as late as 1821 and apparently never returned to his home. Tarín's pregnant wife, Juana Leal, stayed in San Antonio and gave birth to her second son in early 1814; Father Zambrano again served as godfather. There are strong indications that Zambrano's responsibility as godfather to take care of this family in the absence of the husband and father led to a greater intimacy than his clerical state allowed; he was the father of several children born to Juana Leal between 1816 and 1824. Although Zambrano retired from the pastorate of San Antonio in late 1816, he served as acting pastor again in November 1818, when his successor absented himself and never returned. For a few months in 1819 Zambrano also took on the responsibility of the Second Flying Company of San Carlos de Parras (Alamo Company) chaplaincy, since it was also lacking a resident priest. In late January 1820 a new pastor finally arrived and Zambrano again retired from public ministry. When a visiting church official in 1825 ordered Zambrano to celebrate Mass in the Alamo Company's chapel for those living on the other side of the San Antonio River, Zambrano ignored the request, probably because he was already retired from ministry and advanced in age. The angered official decreed that Zambrano was no longer permitted to celebrate Mass until further notice. Father Zambrano died around the end of February 1826.

Don Manuel Tarín, Tejano soldier, was born in San Antonio de Béxar on July 24, 1811, the oldest son of Don Vizente Tarín, an officer in the Second Flying Company of San Carlos de Parras (Álamo de Parras Company), and Dona Juana Isidora Leal, daughter of Don Joaquín Leal. He was baptized two days later by the military chaplain at the Valero mission. The Tarín family lived in a simple jacal near the mission's compound. In April 1813 Manuel's father resigned his command to join the invasion forces of the Gutiérrez-Magee expedition.qv After the rebels' subsequent defeat at the battle of Medina, he fled to Natchitoches, leaving his family behind. When Spanish General Joaquín de Arredondo's troops recaptured the Texas capital, the family's property was confiscated, leaving them destitute. The female members of the insurgents' families, including Manuel's mother, were imprisoned and subjected to the cruelest of conditions for nearly two months. After her release, she and Manuel found refuge with Father José Darío Zambrano, the parish priest of San Fernando Church. Zambrano was a known royalist but was also Manuel's godfather. By 1814, a conditional pardon was issued to the insurgents. Although this restored some of the property that had been confiscated, Manuel's father defied the pardon, forcing the family to remain in the care of the priest for many years.

Manuel became a private in the reorganized Álamo de Parras Company, serving under Lt. Col. José Francisco Ruiz by 1830. That year the Álamo de Parras Company was ordered to build and occupy Fort Tenoxtitlán, a remote frontier garrison on the Brazos River. Over a two-year period sporadic payroll shipments, isolation, and eventually starvation prompted numerous desertions from the post. Tarín deserted twice and each time was arrested and restored to duty with little more than a reprimand. He returned to San Antonio with the Álamo Company in September 1832. His continued discontent with the Mexican military was further demonstrated in the spring of 1833, when he was apprehended with his brother, José Vizente Tarín, and another accomplice attempting to steal guns from the Álamo arsenal. Tarín, like many other Tejano dissidents, ultimately aligned himself with the growing Texas army. He participated in the siege of Bexar in 1835 under Stephen F. Austin's command. By February 22, 1836, he had mustered into Juan N. Seguín's company of Tejanos. Although he was present with Seguín at San Jacinto, illness prevented him from participating in the final battle. He served for the duration of the war and left the army in the rank of corporal in July 1837. For his participation in the revolution, he received several hundred acres in bounty warrants and donation land grants. Manuel married Dona María Luisa Cásares by 1846; they had at least two children. He died sometime after 1849.

Notes for WILLIAM R HENRY:

William R. Henry, was a notorious filibusterer, adventurer, and Texas Ranger. He was born on or about 1821 in Pittsylvania County, Virginia. He was the grandson of the American patriot and statesman, Patrick Henry. Patrick Henry was a lawyer, patriot, and orator, was a living symbol of the American struggle for liberty and self-government. From the day in 1760 when he appeared in Williamsburg to take his attorney's examination before Robert Carter Nicholas, Edmund Pendleton, John and Peyton Randolph, and George Wythe, Patrick Henry's story is inseparable from the stream of Virginia history.

William, while still a young man, ran away from home and lying about his age he joined the US Army. It was during a tour of duty that he found himself in Florida fighting in the "Second Seminole War" (1835-1842), usually referred to as the Seminole War proper. It was the fiercest war waged by the U.S. government against American Indians. The United States spent more than $20 million fighting the Seminoles. This war left more than 1,500 soldiers and uncounted American civilians dead. And the obvious duplicity of the U.S. government's tactics marred Indian-white relations throughout the country for future generations. In 1844, and a veteran of the Seminole War, he came to Texas. While in Texas he would serve his country during the Mexican War (1846-48), joining his old Florida regiment, the Second Dragoons. He saw action in Vera Cruz, Puebla, and Cerro Gordo, Mexico. After the war, he returned to Texas and settled in San Antonio, Texas. On December 11, 1850, he married Consolación Urrutia. Urrutia was the daughter of Don Juan Francisco Antonio Vitoriano Urrutia and Dona Maria Antonia Sandoval. This family were descendents of the earliest settlers of San Antonio, and her ancestry included that of the Canary Islanders that had settled this area. A daughter of this union, Consolación, married Antonio Mateo Bruni. Bruni's acquired property in Webb County, Texas and become one of its' largest landowners.

In the 1850's, Henry took part in and often led some of the most controversial skirmishes along the Texas-Mexican border. As a Texas Ranger he participated in several operations, sometimes with the rank of captain. In July 1855 he attempted to organize an army of volunteers to intervene in Mexico's political affairs and help establish a government that would not threaten Texas interests. In letters to the governor of Nuevo León, Don Santiago Vidaurri, and one of the most powerful men of Northern Mexico, Henry volunteered his services to help Vidaurri, who Henry and others presumed wanted to secede from Mexico and establish a Republic of the Sierra Madre. Vidaurri declined his offer. Henry was a principal instigator of the Callahan Expedition of 1855, which led to the burning of Piedras Negras and subsequently to years of bitter exchanges between the United States and Mexico over Mexico's demand for restitution for the destruction. Between 1856 to 1858, Henry served as sheriff of San Antonio. In 1857 Henry, a staunch supporter of filibusterer William Walker, urged "all my frontier comrades to join me in Galveston" to embark for Nicaragua. As a member of Capt. William G. Tobin's Texas Ranger volunteers he found himself in the Cortina war of 1859. This conflict is named after Juan Nepomuceno Cortina. (1824-1894), the Mexican folk hero. Cortina was born on May 16, 1824, in Camargo, Tamaulipas, Mexico. He was the son of Don Trinidad Cortina and Dona Estéfana Goseascoeches (Cavazos). His aristocratic mother, descendent of the Conquistadors of Nuevo Leon, was one of the heirs of a large land grant in the lower Rio Grande valley that included the area that surrounded Brownsville, Texas. While Cortina was a young man the family had moved to their property on the northern side of the Rio Grande River. (You can find them listed on the 1857 USA census, Cameron County, Texas, #22).

During the Mexican War Cortina had served as part of an irregular cavalry during the battles of Resaca de la Palma and Palo Alto, and was commanded by General Mariano Arista of the Tamaulipas Brigade (based at Matamoros). After the war he returned to his home on the northern bank of the river (USA), where he was twice indicted by a Cameron County grand jury for stealing cattle. Although Cortina frequently appeared in public, his political influence among the Hispanics prevented him from being arrested. He champion civil rights for the injustice and violence that was being inflicted to the Hispanic community of the lower Rio Grande valley. It was this atmosphere that eventually lead to border skirmished that resulted in a great loss of lives. Records show that during this conflict, Henry provided some heroic drama to an otherwise dismal performance on the part of the Texas Rangers. The death of Juan Cortinas brought closure to this era.

"Henry was supremely confident and fearless, but his boldness often bordered on folly. William (Bigfoot) Wallace said that Henry "had rather exalted notions, and was difficult to control. He was brave, and possessed merit, but had the credit of interfering with his superior officers. He was not always in the wrong." Henry's schemes were often grandiose, reflecting that fervor so common at the time in Texas that the United States, and especially Texas, indeed had a hemispheric manifest destiny. On March 15, 1862, Henry quarreled with a man named William Adams over who was going to command the local company of Confederate troops. In a gunfight in front of the old Plaza House on the north side of Main Plaza in San Antonio, Henry was shot dead. An inquest held soon after determined that Adams, having been repeatedly provoked, had acted in self defense". -Manuel Guerra
